What is No Win, No Fee?
No Win, No Fee is an agreement between you and ourselves, as your solicitors, that regulates the funding of the legal costs of making a compensation claim.
The terms of the No Win, No Fee arrangement are set out in a document, known as a Conditional Fee Agreement, or CFA. Schemes vary, but the basic principle of our scheme is that you only have to pay legal costs if you win your case and recover compensation.

How our No Win, No Fee scheme works for dental negligence claims

The legal costs only have to be paid if you win your dental negligence claim and recover compensation. In successful cases we usually recover most of the legal costs from the opponent, in addition to the compensation.
We do not charge you anything if you lose your claim.

Our No Win, No Fee scheme is underpinned by an insurance policy that covers all expenses, such as court fees or the cost of a dental expert’s report. The insurance will also pay your opponent’s legal costs if you become responsible for paying them.
We have special arrangements with a leading insurance company which allows us to offer this cover to our clients.You don’t have to take out the insurance, but we usually recommend that you do so.
The insurance premium is only payable if you win your case, and does not have to be paid upfront. If you lose, then you do not pay anything for the insurance cover.
How much do I have to pay if I win my dental negligence claim?
If you win your dental negligence claim, your opponent will pay most of your legal costs. The legal costs which your opponent does not have to pay are the success fee, the cost of the insurance policy and a proportion of your legal costs.
However, our dental negligence No Win, No Fee scheme guarantees that you will receive at least 75% of your compensation. You may receive more than this, but it won’t ever be less.
How much do I have to pay if I lose my dental negligence claim?
If you lose your claim then you do not have to pay us for the time we have spent dealing with your case (unless there has been dishonesty or fraud).
Nor do you have to pay any expenses such as court fees or medical experts’ fees, as these will be covered by the insurance.
