Case study of a successful dental implant compensation claim
In a recent dental implant compensation claim, our clinical negligence department secured an impressive settlement of £30,000 for a client, thanks to the dedicated efforts of team members Mia Nicholson, and Oliver Thorne.
The dental implant surgery
Our client’s journey began when they sought a dental assessment and consultation. During this initial visit, two severely compromised upper teeth were identified, prompting a recommended treatment plan that included extractions followed by implant restorations.
The client followed the advice and underwent implant placement surgery. However, this was not performed to an acceptable standard. In particular there was:
- Lack of CBCT Scan: A Cone Beam Computed Tomography (CBCT) scan, essential for evaluating bone density and volume, was not performed prior to or during the surgery.
- Unsuitable Implant Guide: The implant guide utilised was inappropriate, resulting in suboptimal implant positioning; notably, one implant was incorrectly placed into the maxillary sinus.
Despite subsequent corrective procedures, the client continued to experience complications, delays in healing, and further failures of the implants. This unfortunate sequence of events led to a drawn-out series of remedial treatments, causing significant emotional strain and financial burden.
The dental implant compensation claim
Our client contacted our free legal helpline for expert guidance. We are experienced in handling dental implant claims and agreed to deal with it on a No Win, No Fee basis.
To build a strong case, we carefully reviewed our client’s dental records and consulted with a leading dental expert who highlighted multiple deficiencies in the dental care provided. Armed with this information, we drafted and presented a detailed Letter of Claim.
The Defendant accepted our legal submissions and made a settlement offer of £15,000.
Recognising the need for a more thorough evaluation of our client’s ongoing condition and prognosis, Mia gathered further evidence related to the cost of future dental treatment and historical financial losses. We argued that this substantially exceeded the Defendant’s offer ,which led to further negotiations taking place and resulted in an out of court settlement of £30,000 being reached.
